was going to put a 38t ring on middle ring position and a 26 on inner and use a double front mech that copes with those size rings.
will this work as not sure if the postion of the rings on a double chainset are the same as the position on the 2 inner ones on a triple.
also are the rings the same distance apart on a double as a triple

I run an old Deore triple with a 22/36 setup. Normal triple LX shifter and a double specific SLX mech. Works fine.
Apparently a standard triple mech will do the job too, but is fiddlier to set up.
As far as I'm aware, on a double specific crank, the spacing between rings is the same, but the rings might be placed further in or outboard...
they;re the same distance apart, so it;s just a case of adjusting the stops and the cable. You can even use a triple shifter.
I've heard though that the SLX double front gives better shifting than a triple front
the spacing between the rings on double and triple chainsets is the same. Though occasionally you come across slight discrepancies between different manufacturers, for example years ago i had an old xtr chainset that was indexing fine and i changed it for a race face and shifting from small to middle was always a little hesitant.
You should be able to use your existing front-mech and just adjust the stop screws.

Then you were doing something wrong, a normal mech should work fine. May get very slightly better shifting with the SLX, but that's designed for 22/36 rings, so it's still not perfect.
I use an M970 crank with 28/40 with triple shifter and mech and it works fine.
I also used 28/40 with a triple front mech just fine.
You just set it up, shift to your new "big" ring, then adjust the H screw so that the mech can't move any further out.
